What is a direct sale with reservation of ownership?

Sale with reservation of ownership (commonly called phased sale) is done by the signing of a purchasing deed subject to a suspension condition, wherein the sale price is fractioned for a period between 5 and 10 years.

What is a suspension condition?

A suspension condition of the sale with reservation of ownership implies that the property remains reserved in favour of the Municipality until full payment of the building has been completed.

How is the phased payment of a subdivision made?

In a sale with reservation of ownership the sale price of the housing subdivision is calculated as referred to in Article 5 of  Regulamento de Alienação de Imóveis Municipais (1.4 MB) and can be fractioned in monthly instalments, with no interest rates, between a minimum period of 5 years  and a maximum of 10 years.  The value of the first instalment may never be under 15% of the sale price.

 

Added to the monthly instalments are expenses with administration, conservation and usage of the building’s common areas.

What are the candidate’s requirements for a purchase with reservation of ownership?

The candidate for a direct sale with reservation of ownership must comply with the following requirements, no debit for rent or payment agreement and he must also comply with the requirement of the condition of resources, that is, the rate of effort of the purchaser for the payment of the monthly instalment may not be less than 20% nor above 40% of the declared gross income and stated in the IRS settlement certificate.

If the resident has chosen the format of a phased sale, can he, at any time, pay all the remaining amounts in one instalment?

Yes, the purchaser can, at any moment, fully or partially pay the amount in debt anticipating the end of the suspension condition of the purchase deed.

How is the paying of the instalments made?

The instalments are paid monthly until the 8th day of each month through direct debit and within the terms established in the purchase deed.

What are the consequences of non-payment of monthly installments?

Delay in fulfilment of the monthly installments and their non-settlement, determine the resolution of the contract and loss in favour of the Municipality, of all amounts paid and it implies evicting the subdivision.

And if the purchaser cannot pay the installments by reason of force majeure?

If default in the payment of installments is justified by reason of death, disability, unemployment of the purchaser or any member of his household, the Municipality shall terminate the contract, and the household may remain in the same housing with the signing of a rental agreement under the system of supported rent.
